City breaks ground on I-5 on ramp, paid Petrovich $2.5 million for land

At 11 am today the City of Woodland held the Woodland I-5 / CR-102 Interchange Project Groundbreaking at the southeast corner of Interstate 5 and County Road 102, adjacent to the site of Sacramento developer Paul Petrovich's Gateway Shopping Center. According to the city's project Web site, "construction of portions of this project is required by the environmental document for the Gateway project" and is scheduled to be completed in 15 months. The city also stated that "federal transportation funds are paying for 80% of the project and the remaining 20% are local funds."
What's not mentioned is that the city paid Petrovich $2.5 million for the land. According to the "Gateway Center Agreement"
(article 3.14) "Compensation to owner [Petrovich] for land dedicated to city for interchange ramp. City shall compensate owner for the fair market value of the land dedicated by owner to city for the I-5 interchange ramp, as determined by an appraisal obtained through a mutually acceptable methodology." So did C.O.W. get anything for letting P develop Gateway? Has the city got $2.5 mil in sales tax? Has the center even covered extra services required of C.O.W.???
I guess I missed something. I thought that Petrovich was supposed to build that interchange in exchange for letting him build Gateway. Didn't he have to do the road project for all the increased traffic to that intersection?

You thought wrong. Petrovich is not building the interchange. There was no exchange for letting him build Gateway.
Pages 13 and 14 show a chart of project cost sharing for improvements along CR 102 only UP TO the ramps.
For unknown reasons, rather than doing some sort of exchange, the city agreed to buy the land necessary for the on ramp from Petrovich to the tune of $2.5 million.
If it's not obvious already, citizens really need to look closely at the relationship between the city, under Kirkwood, and Petrovich.
The project's website is essentially useless. There's no real plans/dates/etc.

I just posted over at the DD blog to correct some misinformation...... again. Some chump named "Woodland Conservative" wrote this:
"Glad it's happening, could have used all the money they put into 98 and Kentucky into it... All of you Petrovich haters please note "contributed a large amount of money to the project in order to help mitigate the increased traffic in the area caused by the opening of the Gateway Shopping Center"."

Mayor Rexroad moved and Council Member Pimentel seconded to accept
the Sub-Committee recommendations with the five acres having a two year restriction, no restriction on the grocery element and the $1 million to the downtown upon first occupancy.
Council Members Peart and Pimentel agreed on their opposition to a grocery restriction.
On a motion by Council Member Peart, seconded by Council Member
Monroe and carried, Council took the following actions with the changes (1) the $1 million will go to the Downtown upon first occupancy; (2) the two year set
aside on the five acres will begin this day; (3) no grocery restrictions.
Council Member Peart called for a separation of the vote for items 1 through 3 and items
(a) through (g) and a roll call on the items 1 through 3 as follows:
AYES: Council Members Flory, Monroe, Pimentel, Rexroad
NOES: Council Member Peart
ABSENT: None
ABSTAIN: None
The vote on the following actions was unanimous approval:
(a) Adopted Resolution 4606, a “Resolution of the City Council of the
City of Woodland Adopting CEQA Findings of Fact; Adopting a
Statement of Overriding Considerations; Adopting a Mitigation
Monitoring Plan; and Certifying the Final Environmental Impact
Report for the Woodland Gateway and Auto Center”.
(b) Determined that the project, as conditioned, is consistent with the
General Plan and Zoning.
(c) Conducted the First Reading of an Ordinance to amend the Zoning
Ordinance to allow for regional shopping center uses in the C-H
and EOZ zone, (Attachment C of January 18, 2005 Council
Communication).
(d) Conducted First Reading of Ordinance to approve a Development
Agreement between Woodland Investment Company, LLC and the
City of Woodland (February 1-Attachment C).
(e) Approved Master Conditional Use Permit per conditions in
Attachment E of January 18, 2005 Council Communication.
(f) Approved tentative parcel map with conditions in Attachment E of
January 18, 2005 Council Communication.
(g) Continued to February 15, 2005 for second reading of Ordinances
and final approval of project.
Mayor Rexroad left the meeting at 8:19 and returned at 8:21.

Care to fill us in on what this is about and when it occurred? I presume it's about Gateway... and judging by the dates, this meeting happened about Jan. or Feb. 2005.
The final agreement for Gateway happened in 2006 with no stipulation that the "downtown" receives $1 million - if that is your point.

Funny, I didn't get that point at all - although I do think city council should have all their meetings live (and recorded) on their Web site.
Why couldn't 9:40 just simply say his/her "records" (not really his/hers, the minutes are posted online) are from the Feb. 1 , 2005 council meeting? Here's the agenda item:
